Is it legal to play casino online in Nevada?
You would think so considering the fact that Nevada is known to be a gambler’s paradise, but no, it is not legal to play casino online in Nevada. In the state law, the criminal code of NRS 463.016425 makes it very clear that it’s illegal to send or receive money from gambling sites:
“’Interactive gaming’ means the conduct of gambling games through the use of communications technology that allows a person, utilizing money, checks, electronic checks, electronic transfers of money, credit cards, debit cards or any other instrumentality, to transmit to a computer information to assist in the placing of a bet or wager and corresponding information related to the display of the game, game outcomes or other similar information.”
The exception to the above is a single online poker site that is regulated by the Nevada Gaming Control Board. State based online poker was legalized in 2011. However, as it never took off there is only one gambling site that is actually offering the possibility to legally play poker over the internet in Nevada.
If it’s illegal how can there be so many online casinos in Nevada?
All gambling sites that allow Nevadans to sign up and play with them are located outside of America (so called offshore casinos). While the state of Nevada isn’t happy about the fact that these casinos allow residents to sign up and play with them, it’s very difficult for them to do something about it.
There has been one occasion though where a guy was arrested for illegally running a poker site. While the site itself was located outside of America, this guy was, however, living in Las Vegas. This probably made it a lot easier for the law enforcement to take action.
Will I get in trouble for gambling at offshore casinos?
We are not lawyers so you shouldn’t take our word for it, but our two cents are that it’s extremely unlikely that anything would ever happen to you for gambling online. As far as we know – from the thorough research that we have done – no one has ever been penalized for playing at an offshore casino.
We don’t know how many Nevadans actually gamble online, but as the benefits are many compared to land based gambling we would assume that it’s quite a lot. And if no reports can be found of anyone being arrested for their gambling it’s pretty much safe to say that the risk is non-existent.
A brief look at the history of gambling in Nevada
1800s: In the mid-1800s, before becoming a state, gambling was wide-spread in Nevada – much thanks to its rich silver and gold mining culture.
1861: Appointed as governor by Abraham Lincoln, James Nye is criminalizing gambling and imposing harsh penalties on anyone partaking in it.
1864: Nevada is recognized as a state and along with it new legislatures are attempting to legalize gambling. Their attempts do, however, fail.
1865: A bill passes that decriminalizes the participation in luck based games and reduces the penalties for those who organize gambling. This results in a major boom of underground gambling.
1909: Due to a progressive movement gambling is once again made illegal and so is the consumption of alcohol. This only boosted the underground market for gambling as well as alcohol.
1931: Nevada becomes the first state to legalize casino gambling and sports betting. The first four operators to receive a gambling license are Boulder Club, Exchange Club, Las Vegas Club and Northern Club.
1955: The entity regulating gambling in Nevada is created – The Nevada Gaming Control Board.
1997: Greyhound racing is made illegal.
2007: As the great recession hits, many of Nevada’s casinos reinvent themselves to become all-around entertainment destinations with shopping areas, golf courses and sports arenas.
2011: Nevada becomes the first state to legalize online poker.
2013: The first US regulated poker site in America launches – Ultimate Poker.
2014: As a result of poor revenue Ultimate Poker shuts down. As the online poker market had been very underwhelming an agreement is signed with Delaware to share a poker network. This means that players from both states are able to play against each other. This network takes effect the following year.
2016: Legalizing online casinos is up for discussion, but gets nowhere.
2017: The amount of online poker players dramatically increases as New Jersey joins Nevada and Delaware on their shared poker network.
In addition to the above, it should be mentioned that there have been about 30 attempts to legalize a state run lottery program since 1975. Nevada is, however, still one of just a handful states that hasn’t legalized this yet.
Land based casinos in Nevada

Do different casinos have different house edges?
